Castellan Smart Access

These Terms govern the use of the Castellan Smart Access platform, applications, connected controllers and related services.

By creating an account, accepting an invitation, administering a property or using Castellan to control an access point, the user agrees to these Terms.

Castellan is an access-management and remote-command platform.

Castellan allows authorised users to send access commands to compatible gates, doors, barriers and other connected access equipment.

Castellan does not itself constitute the primary mechanical or electrical safety system of the connected equipment.

All access equipment connected to Castellan must have any required safety systems correctly installed, enabled and maintained.

Castellan must not be installed, configured or used in a way that bypasses, disables or interferes with safety beams, obstruction detection, anti-crush protection or other required safety functionality.

Unless expressly supplied by Castellan, the underlying gate motor, gate, door, boom, barrier, safety beam, electrical installation and other physical equipment remain third-party equipment.

Castellan does not manufacture such equipment and does not warrant the mechanical reliability, condition or suitability of third-party equipment.

The property owner, body corporate, managing agent, business or other responsible party remains responsible for:

• the physical condition of the access equipment;
• routine maintenance;
• safety devices;
• electrical safety;
• mechanical safety;
• compliance with manufacturer requirements; and
• ensuring that the equipment remains suitable for powered and remote operation.

Users must:

• keep their login credentials secure;
• not permit unauthorised use of their account;
• only operate access points they are authorised to use;
• use remote access responsibly;
• revoke temporary or visitor access when appropriate;
• report suspected faults or security issues; and
• not intentionally operate equipment in an unsafe manner.

Users and administrators may be permitted to issue temporary or visitor access.

The person issuing such access is responsible for ensuring that the intended recipient is authorised to receive it.

Temporary credentials must not knowingly be distributed to unauthorised persons.

Castellan relies on technology which may include:

• internet connectivity;
• local networks;
• mobile networks;
• cloud services;
• power supplies;
• third-party equipment; and
• external infrastructure.

Service availability may therefore be affected by circumstances outside Castellan's reasonable control.

Castellan does not guarantee uninterrupted or 100% continuous availability.

Castellan will take reasonable technical and organisational measures to protect the platform and user information.

Users remain responsible for maintaining the security of their own credentials, devices and connected networks.

Castellan may maintain records relating to access events, including users, access points, dates, times, permissions, commands and system events.

These logs may be made available to authorised property administrators where appropriate.

To the maximum extent permitted by applicable law, Castellan will not be responsible for losses arising solely from:

• failure or malfunction of third-party gate or access equipment;
• disabled or defective safety systems;
• failure to maintain physical equipment;
• unauthorised use caused by a user's failure to protect their credentials;
• internet, mobile network or electricity outages outside Castellan's reasonable control; or
• use of Castellan contrary to these Terms or published safety instructions.

Nothing in these Terms excludes or limits any liability, right or remedy which may not lawfully be excluded or limited under applicable South African law.

Where Castellan performs or arranges installation, installation must not intentionally bypass or disable required safety systems.

The installer may refuse to activate Castellan where the access equipment appears unsafe or unsuitable for remote operation.

Castellan may suspend remote access to an access point where there is a reasonable concern relating to:

• security;
• fraud;
• unauthorised access;
• unsafe operation;
• system abuse; or
• a material breach of these Terms.

These Terms may be updated from time to time.

Where material changes are made, users may be required to accept the updated version before continuing to use certain Castellan services.

These Terms are governed by the laws of the Republic of South Africa.
